The Tasmanian government has released its controversial Macquarie Point stadium legislation and supporting material for public consultation.
If passed, the legislation will issue the planning permit, without requiring approval from the usual bodies in regards to developments.
And it also stops any rights of appeal.
Greg Barns is a spokesperson for the Australian Lawyers Alliance and tells Kylie Baxter on Hobart Drive he has particular concerns over the limitation on rights of appeal, calling it “extraordinary” and “dangerous” to democracy.
“I will be surprised … if this clause does not get challenged, because the High Court and other courts around Australia don’t like these clauses, and for a very good reason,” he says.
“This should never be in legislation in a democracy.”
